CMS Issues Final Rule on Medicare Secondary Payer Recovery Portal

Last week, The Centers for Medicare and Medicaid Services (CMS) published a final rule regarding its Medicare Secondary Payer Recovery Portal (MSPRP).  This rule introduces a process and timeline for enhancing the portal in an effort to bring it into compliance with recently passed legislative requirements (Section 201 of the Medicare IVIG and Strengthening Medicare and Repaying Taxpayers (SMART) Act of 2012).

The final rule specifies a timeline for developing a plan to allow authorized users, other than the beneficiary, to obtain conditional payment amounts and claim details via the MSPRP.  It also adds functionality to the portal that will permit users to: 1) notify CMS of pending case settlements, 2) obtain time and date stamped conditional payment statements before settlement, and 3) ensure that disputes are addressed within 11 days of receiving the necessary supporting documentation.
